Abstract MicroCog test results and supplemental neuropsychological test findings are reported concerning a male health professional who had abused nitrous oxide (N2O) on a regular basis for more than 20 years. At the time of the examination, the health professional had abstained from N2O use for 12 months. Test findings indicate that the patient had suffered a general decrement in cognitive functioning. Spatial functioning and reaction times were better preserved than attention, mental control, verbal and arithmetic reasoning, and verbal memory. His verbal memory loss was particularly severe, but abstract reasoning and practical social judgment remained intact. Marked visual memory and construction deficits were identified with supplemental clinical tests. Since 12 months of abstinence had elapsed prior to the examination, it may be reasonably assumed that cognitive recovery was nearly complete and the findings reported are stable. Key Words: chronic substance abuse, nitrous oxide abuse, cognitive deficits, neuropsychological deficits Nitrous oxide ([N.sub.2]O) abuse is rarely seen in the general practice of clinical and forensic psychology. Also, little has been reported on the cognitive consequences of chronic [N.sub.2]O abuse. For this reason, we offer the results of a neuropsychological evaluation completed in a VA Medical Centers Outpatient Behavioral Medicine Clinic on a chronic abuser of [N.sub.2]O.

ABSTRACT Workplace bullying is a phenomenon that is attracting increasing interest from researchers throughout the Western world. To date, most of the research into workplace bullying has focused on managers and colleagues as the perpetrators of bullying in the workplace. By contrast, little is known about upwards bullying, where managers are the targets. We argue that in order to more fully understand workplace bullying as a whole, the phenomenon of upwards bullying requires research attention. In the present study, upwards bullying was explored in interviews conducted with 24 managers from public and private organizations, with the data coded and arranged thematically. Results indicate that potential contributing factors towards upwards bullying include the current work environment, change within organizations and power issues. We recommend that organizations identify the occurrence and processes of upwards bullying as important steps in developing comprehensive workplace bullying policies. While it is legitimate that the predominant focus of research has been on managers as the perpetrators of workplace bullying (British studies have consistently found those in superior positions to be perpetrators of workplace bullying - Zapf, Einarsen, Hoel Vartia 2003), we contend that, in order to fully understand the broad phenomenon of workplace bullying, upwards bullying requires our attention. Such a focus has potential to impact on our theoretical understanding of workplace bullying, and to highlight important recommendations for managers, staff and organizations. Despite limited usage of the term upwards bullying (Lewis Sheehan 2003; McCarthy, Henderson, Sheehan Barker 2002; Rayner Cooper 2003), there does appear to be general agreement in the literature that managers can indeed be the targets of workplace bullying from their staff (e.g. Zapf et al. 2003). For example, Hoel, Cooper and Faragher (2001) found in their study of the impact of organizational status and workplace bullying that 6.7% of respondents had been bullied by staff. Furthermore, prevalence studies into workplace bullying have identified the occurrence of upwards bullying as between 2% and 27%, with a mean of 11% (see Zapf et al. 2003). However, cases of upwards bullying are reported in the literature rarely (Rayner Cooper 2003) and are often presented anecdotally or as single cases (see Braverman 1999, for example).

MOAB — A Grand County judge denied a motion to close the preliminary hearing of 28-year-old Rex Allen Cross, accused of killing three people while driving drunk. The Deseret Morning News, the Salt Lake Tribune and The Associated Press took the lead in opposing the motion to close the preliminary hearing, with the Moab Times Independent and the Uintah Basin Standard joining. All of the media were singled out in defense attorney Robert Archuletas motion as potentially prejudicing the jury pool and compromising Cross right to a fair trial. Cross faces three felony counts of vehicular manslaughter stemming from a head-on collision on U-128 just outside of Moab. Cross is accused of driving drunk Oct. 3 when his car collided head-on with a car driven by Kathleen Perry. Kathleen Perry, 35, and her parents, Olive Parry, 67 and James Parry, 72, were killed in the accident. Kathleen Parrys 6-year-old daughter, Emma — who was also in the car at the time of the accident — survived. Emma is now living with relatives in Roosevelt. Seventh District Judge Lyle Judge Anderson ruled against the motion for a closed preliminary hearing after Grand County Attorney Happy Morgan agreed to conduct the hearing without reference to issues Archuleta may move to suppress in trial. Those include a blood draw taken from the defendant after the accident and a discussion the defendant allegedly had with investigating deputy Curt Brewer. Salt Lake attorney Michael OBrien filed an 11-page argument with the 7th District Court last week on behalf of the media and made an appearance by phone Tuesday. In his brief, OBrien maintained that “constitutional and common-law rights of access to courts and documents related to the actions of the courts” overrides the defenses claim that an open hearing will prejudice the jury pool.

BACKGROUND. The purpose of this study was to examine and compare the approaches of family physicians and obstetricians when evaluating and managing women with preterm contractions or labor.RESULTS. When asked their three most common treatment strategies for women with preterm labor, family physicians were more likely than obstetricians to select beta-agonists and hydration. Obstetricians were more likely to include magnesium sulfate and nifedipine in their treatment plans. For women with preterm contractions and no change in cervix, obstetricians were more likely to select either of the two short-term tocolytic therapies, while family physicians were more likely to select less aggressive therapy approaches. When adjusted for the facility in which they practiced and the number of years of experience, family physicians were nearly one half as likely as obstetricians to use tocolytics to treat women who had contractions but no cervical changes.CONCLUSIONS. In general, obstetricians were more likely to select more aggressive therapy for women with premature contractions without changes in cervix. Since it is unlikely that patient preferences would influence the choice of strategies for preterm labor, it is likely that these results reflect true differences in physician practice patterns based on physician specialty.KEY WORDS. ORLANDO — Hospital teaching staff was more likely to adhere to American College of Obstetricians and Gynecologists guidelines for scheduling cesarean deliveries than were physicians in private practice, according to a retrospective chart review, Dr. M. Ryan Laye said at the annual meeting of the South Atlantic Association of Obstetricians and Gynecologists. Of the 296 patients being delivered by scheduled cesarean section for elective indications at the hospital, 222 (75%) were delivered in accordance with the American College of Obstetricians and Gynecologists recommendations for timing of elective delivery. Of those not adhering, 95.5% were private service patients, and 4.5% were teaching service patients. The admission rate for the neonatal intensive care unit in both groups was 3.7%, which is consistent with the rates for all cesarean deliveries, as reported in the neonatal literature, Dr. Laye said.

The advertising and public relations world has continually brought physicians names to the public. Ten years ago if a doctor called himself a cosmetic surgeon, the patient knew precisely what that title meant. Currently, doctors in various sub-specialties, such as dermatologists, gynecologists, opthamologists and even dentists, are performing cosmetic surgery procedures. This can utterly confuse prospective patients trying to find the most qualified surgeons. How, wonders Dr. Stanley Taub, a New York City plastic and reconstructive surgeon, “is a prospective patient to know who is a diligent, excellent, caring physician and who is a charlatan?” Taub wants to disseminate information the public can use to select a cosmetic surgeon in a country now brimming with doctors calling themselves “cosmetic surgeons.” “Public law and policy do not necessarily protect us from unreasonable and untrue claims,” declares Taub. “A physician needs to be licensed in medicine which means earning a recognized medical degree–and can hang out a shingle in any specialty he chooses. The state does not control what area of medicine he practices or which type of specialist he says he is unless there are complaints and he is brought before the Office of Professional Medical Conduct. Often, however, by then it is too late.” How do we ascertain a physicians expertise and qualifications before placing ourselves under his or her care? Four basic areas must be investigated–a physicians training, certification, associations and attitude toward his or her patients. “A physician should have and be willing to provide evidence that he or she has trained in the area of their expertise,” Taub states. “For example, patients want to locate a plastic surgeon who trained in plastic surgery, which means a post-surgical residency fellowship in the sub-specialty. Each residency or fellowship program gives a certificate [indicating] the dates of service as well as the hospital or department in which the physician trained.” Most physicians keep certificates and other diplomas framed in their offices. If these are unavailable, at least a curriculum vitae or brochure describing a doctors training should be available and carefully examined by the patient. “If a physician is either unable or unwilling to disclose this information, it becomes a clear issue of medical consumer beware,” Taub warns.

Over the past 18 years, the author has observed patterns in large income property loan portfolios during both inflationary and deflationary investment cycles. An inflationary investment cycle is when rents-prices for investment properties are increasing in aggregate. This inflationary trend occurred in the San Francisco Bay Area Tech Boom period from 1997 through 2000. A deflationary investment cycle is when rents-prices for investment properties are declining in aggregate. There is significant evidence to support a deflationary trend in the San Francisco Bay Area investment properties commencing 2001 with a 3- to 5-year duration.Income property portfolios react similarly to chaotic or non-predictive patterns in other investment portfolios such as stocks and bonds. The primary difference is that the time of change is very slow as measured in years in income property loan portfolios compared to the more volatile stock or bond portfolio reaction measured in days. This time difference is rather large since it typically takes 6 minutes to sell a stock versus 6 months on average to sell an income property. These “sell times” are averages from the point an investor decides to market an investment to the time net proceeds are received. Further, income property transaction times extend or contract depending on market conditions. Historically, income property is considered a safe, predictive investment alternative compared to the more volatile-chaotic stock or bond markets. Investor winners and losers are measured daily in the stock and bond markets, while income property portfolios are measured over years. Income property investments move so slowly that most investors believe it is predictable. Since the average “sell time” takes six months, deflationary pressures can have a significant negative impact on income property investments held over long periods of time. Predicting when or if deflation will hit a market is debatable between buyers and sellers. As it takes about 6 months to get out of a property, investors display a propensity to hold on longer during the beginning of deflationary cycles. Therefore, when it is time to sell, most investors have waited too long to capture the sales gain at the market top. Most investors discover when the top of the inflationary market occurred after they are already on the investment cycles down slope. When investors in aggregate believe it is time to sell, it is often too late as the top of cycle has already occurred. When investors try to sell on the down slope with vacancies increasing and with downward pressure on rental rates, it is very difficult sell since buyers typically have an uncertain outlook and are waiting on the sidelines for lower purchase prices. Spieker Properties, with the benefits of hindsight, selling to Equity Office is one example of a sale near the top of the inflationary cycle in February 2001. This transaction was observed by many CREs as the best-timed major income property portfolio sale in the San Francisco Bay Area marketplace.Given the recent 10-year investment cycle (1991-2001) in the San Francisco Bay Area, the first 5 year-period through 1996 was in aggregate deflationary for income investment properties purchased or refinanced from the previous inflationary period1986 through 1991. The last 5 years (1997 through 2001) was an inflationary period with rents/values in aggregate increasing on properties because of high demand for space related to the Tech-Boom economic expansion. Given existing lackluster demand with negative net absorption in the San Francisco Bay Area and given very high vacancy rates, the next five years will result for many property types deflationary pressures on rents/values for investment properties in aggregate. There will be exceptions. Some properties will not experience deflationary pressure in rents or investment sale prices because they have long-term leases backed by quality tenants occupying the entire property or are a “one-of-a-kind” superior location property.
