INTRODUCTION The consumer injury requirement can be understood as an element to be proved before liability can be found under the antitrust laws. This requirement serves two purposes in addition to the protection of consumers from truly anticompetitive practices. First, the requirement facilitates the expeditious resolution of legal disputes. Second, the requirement establishes clearer guidelines for businesses that are wary of running afoul of the antitrust laws. These effects are particularly important because of the threat of lawsuits by competitors. The Clayton Act permits private plaintiffs to seek monetary and injunctive relief for violations of the antitrust laws. Under section four, any person who has been injured in his business or property by “anything forbidden in the antitrust laws” may recover “threefold the damages by him sustained, and the cost of suit, including a reasonable attorneys fee.”7 Section sixteen of the Clayton Act provides that “[a]ny person, firm, corporation, or association shall be entitled to sue for and have injunctive relief. against threatened loss or damage by a violation of the antitrust laws..”8
In five consolidated cases, passengers alleged airline negligence for personal injuries they received when ( 1) luggage fell from an overhead compartment, striking a passengers head; (2) a woman did not receive the disembarking assistance she requested and was then injured while exiting the plane; (3) a flight attendant hit a passengers shoulder with a service cart; (4) a passenger tripped over luggage allegedly left in the aisle by a flight attendant; and (5) a passenger fell while boarding a motel shuttle bus after being denied passage by an airline. The trial courts held the suits involved the rendering of “services” and were preempted by the ADA. Reversing, the Ninth Circuit noted that although the LI Supreme Court has never defined “service” under the ADA, it has indicated in two cases that the ADA does not preempt most state law tort claims. The court here said that Congresss purpose in enacting the ADA was to achieve economic deregulation of the airline industry. The purpose of the statutes preemption clause is to avoid interference with that deregulation. Nothing in the statutes language or its legislative history indicates that Congresss purpose was to displace state tort law in actions that do not affect deregulation in more than a peripheral manner, the court said.
In a case where an employer made sufficient safety devices available and an employee had been instructed to use the devices, this injured employee may not recover under Labor Law Section 240(1) for injuries he sustained based solely on his violation of the instructions. This was the finding of New York States highest court in Timothy Cahill v. Triborough Bridge and Tunnel Authority. The plaintiffs motion for summary judgment was granted by Supreme Court and affirmed by the Appellate Division. However, the New York State Court of Appeals reversed, concluding the defendant had no liability under Labor Law Section 240(1).

Falling during the same month as the Jewish observance of Chanukah or Hanukkah (the Feast of Lights) and the African-American celebration of Kwanzaa the season of Christmas serves as a time of celebration feasting and a search for miracles.While Christmas generally is considered the celebration of Jesuss birth the early Puritans who settled the New England region refused to celebrate the occasion. Disagreeing with the early church fathers who established the holiday around a pagan celebration for easy remembrance by the poor the Puritans considered the observance secular in nature. Set during the winter solstice when days grow dark early Christmas coincides with the Roman holiday of Saturnalia; the date December 25 marks the celebration of Dies Natalis Invicti Solis or the birth day of the Unconquered Sun by the Romans. Puritans believed that these pagan customs which included no work feasting and gift giving were inappropriate for the celebration of the Lords birth. While the northern colonists did not observe the day the southern colonists celebrated in much the same style as their British counterparts–with banquets and family visits. Firecrackers or guns were used to welcome the Christ Child at midnight on Christmas. The residents of New York (New Amsterdam) celebrated the season in a similar fashion as their Dutch ancestors had with St. Nicholas Day (December 6) established to honor the patron saint of children. Gradually all observances became centered around the date December 25 with traditions becoming mixed and accepted between different ethnic backgrounds.

During the construction of a new plant along the Houston, TX, Ship Channel in 1963, three identical compressors were installed on concrete foundations. Prosperity in the U.S. construction industry was again on the house, as the residential segment continues to exhibit most of the recent growth in the domestic building industry. The construction industry appears to be hovering at a level close to last years pace, says Robert A. Murray, vice president of economic affairs for McGraw-Hill Construction. Housing remains very healthy, and the upturn for non-residential building in February was a welcome development after a sluggish January.

Call me slow on the uptake, but I had no idea that getting engaged would be so . . . different.
